As a developer sells the units that it has constructed, it will gradually lose control of the association’s Board of Directors. In this class, will discuss the required turnover of board control mandated by state law, how to measure the turnover of control, and common pitfalls and sources of conflict (in litigation) related to the declarant control period. We will then discuss the developer’s obligations at turnover and ways to address the developer’s failure to fulfill these obligations.
