Nuisance-like violations are becoming increasingly common for community association boards and community association managers. While they are not always easy to resolve, there is a reasonably straightforward path that can be followed by boards and managers to analyze these types of complaints and to determine the association’s responsibility to address them. We will discuss common governing document provisions, specific rules that address these types of violations, and a path for boards and managers to conduct due diligence so that any decision that is made is more likely to be defensible if the parties end up in court.
