HB 19-1189 brings about substantial changes to wage garnishments in Colorado. The bill has three major changes that every Colorado community association should know:

  1. Lowers the amount that a creditor can collect from each wage garnishment from 25% of an individual’s take home pay to 20% of an individual’s take home pay;

  2. Requires the creditor to give notice to the individual of the wage garnishment; and

  3. Further reduces the amount of take home pay subject to garnishment on a dollar-to-dollar basis equal to any premiums an individual is paying for employer-provided health insurance.
