In this class, we will go through CCIOA’s Section 217 in great detail and discuss what impact it has on Association document amendments. Most of these impacts are considered favorable to an association, although in some cases they can be unhelpful. We will discuss when the mandatory 67% owner approval threshold applies and when it does not. We will discuss cases interpreting this section of CCIOA and discuss the provision of 217(7), which is the court petition for a declaration amendment. We will conclude with a discussion of its analogous provision in the nonprofit act, which could be applicable to amendments to bylaws and articles of incorporation that cannot be addressed through CCIOA.
