In this class, we will discuss CCIOA’s section 305, which allows an Association to terminate contracts and leases entered into by the declarant under certain circumstances. We will discuss common situations where this provision may be invoked to terminate an agreement, and where boards might attempt to attempt to use this provision to terminate other agreements not falling within section 305’s termination right.
