SB20-211 Extended to June 1, 2021

On January 21, 2021 Governor Jared Polis signed SB21-002 (Senate Bill 21-002) Extending Limitations on Debt Collection Actions into law. SB21-002 extends the provisions of SB20-211 (Senate Bill 20-211) Limitations on Extraordinary Collection Actions. Under SB21-002, the provisions of SB20-211 are extended to June 1, 2021.

Prior to taking any Extraordinary Collection Action which is defined as “any action or proceeding in the nature of attachment, garnishment, levy or execution to collect or enforce a judgment or debt” the judgment creditor must send a letter as provided in SB20-211 to the debtor allowing such debtor to elect to extend the time period of such action being taken until after June 1, 2021. To elect such extension, the debtor need only state that they are suffering financial hardship due to COVID-19.

If a debtor previously elected to extend an extraordinary collection action under the provisions of SB20-211, the provisions of SB21-002 provide that such prior election shall automatically be extended to June 1, 2021 without further action of the debtor.
