In this class, we will discuss attorneys fees, in the context of when they can and when they cannot be assessed to an owner. We will discuss the difference between a collection case any covenant enforcement case in reference to attorneys fees, statutory authority on these types of actions, common document provisions, and then troubleshoot common attorney fee shifting scenarios such as owner delinquencies, covenant enforcement issues, civil rights complaints or other regulatory disputes, the abusive owner, as well as owners who demand disproportionate amounts of board or management attention on an ongoing basis, and similar scenarios.
