Condominium Underwriting Guidelines

Following the collapse of the Champlain Towers South condominium tower in Surfside, Florida, the federal government has revised condominium underwriting guidelines to (attempt to) minimize federal government underwriting risk for condominium projects. As a general matter, they are asking for confirmation that the condominium infrastructure is sound or if it is not sound, to what extent it is problematic, what documentation the association has to justify the current condition, and its future plans to address those problems. We will briefly discuss what questions are asked under the new questionnaire, what duties the Association generally has to respond to it, and general best practices for responding to the questionnaire given the liability associated with this issue.
